Terms of Service: UK Addendum.
Effective September 24, 2026 · Supercomplicated LLC
Last updated: 24 September 2026
IMPORTANT — PLEASE READ CAREFULLY. This Addendum forms part of the HeyFitt Terms of
Service (the "Terms").
>
The Service is not offered in the United Kingdom. Terms Section 2.7 states that, and it
is accurate: HeyFitt is offered to persons in the United States, and it will not find the
gyms you train at if you are somewhere else. This Addendum exists for the case where
somebody in the United Kingdom uses the Service anyway and United Kingdom law is found to
apply to that use. It is not an offer of the Service in the United Kingdom and is not
evidence that we direct the Service there.
>
Where it applies and conflicts with the Terms, **this Addendum governs for the matters it
covers**, and the Terms continue to apply in every other respect. Nothing in this Addendum
or the Terms affects statutory rights that cannot be excluded or limited by agreement.
A1. Who this Addendum applies to
- UK consumers. Where United Kingdom law applies to your use of the Service and you are
an individual using it wholly or mainly outside your trade, business, craft, or profession,
this Addendum applies to you. Sections A3 to A11 exist because certain UK statutory
protections, where they apply, cannot be contracted away.
- Business users are not covered by Sections A3 to A11. If you use the Service in the
course of a business — including every trainer, coach, studio, gym operator, or other
professional using HeyFitt for Trainers, and any company, partnership, or sole trader —
you are not a consumer for these purposes. **Sections 20 and 21 of the Terms apply to
you in full**, including the arbitration agreement, the class action waiver, Massachusetts
governing law, and exclusive Massachusetts venue. Section A2 applies to you.
- If you are a consumer for some dealings with HeyFitt and a business user for others, this
Addendum applies only to the dealings in which you act as a consumer.
A2. Governing law
- **These Terms and any dispute arising out of them or the Service are governed by the laws
of the Commonwealth of Massachusetts and applicable U.S. federal law**, without regard to
conflict-of-laws rules. Questions concerning the existence, powers, internal affairs,
governance, or corporate acts of HeyFitt and its affiliates are governed by the laws of the
State of Delaware.
- The one limit on Section A2.1, for UK consumers. Where you are a consumer resident in
the United Kingdom, that choice of law does not deprive you of the protection of provisions
of the law of the United Kingdom that cannot be derogated from by agreement. Those
provisions apply in addition to the law chosen above; Massachusetts and Delaware law govern
everything else.
A3. Where disputes are heard
- HeyFitt's claims against you, and your claims where you are a business user, are heard
exclusively in the state courts located in Middlesex County, Massachusetts, or the United
States District Court for the District of Massachusetts, and you consent to the personal
jurisdiction of those courts.
- Your claims, where you are a UK consumer. You may bring proceedings in the courts of
Massachusetts under Section A3.1, and you may instead bring them in the courts of the part
of the United Kingdom in which you live. HeyFitt may bring proceedings against you only in
the courts of the part of the United Kingdom in which you live, or in Massachusetts where
you have agreed to that forum in writing after the dispute arose.
- Arbitration is available to you, and is not required of you. Section 20 of the Terms
(arbitration and class action waiver) does not apply to a UK consumer unless you choose it
after a dispute has arisen. If you do choose it, Section 20 governs that arbitration in
full. Your decision not to arbitrate is not a breach of the Terms and does not affect any
other right you have under them.
A4. Your statutory rights
- The Service is supplied to consumers subject to the Consumer Rights Act 2015. Where the
Service is supplied as a digital service, it must be of satisfactory quality, fit for a
purpose made known to us, and as described. Where we supply a service, it must be performed
with reasonable care and skill.
- Nothing in the Terms excludes or restricts those rights, or any remedy for their breach.
Where a provision of the Terms would do so, it does not apply to you to that extent, and the
remainder of that provision and of the Terms continues in force.
- Advice about your statutory rights is available from Citizens Advice or your local Trading
Standards service.
A5. Liability
- HeyFitt does not exclude or limit its liability for death or personal injury caused by
its negligence, for fraud or fraudulent misrepresentation, or for any other liability that
cannot be excluded or limited under the law of the United Kingdom. Section 18 of the Terms
is read subject to this paragraph.
- Subject to Section A5.1, Section 18 of the Terms applies in full, including its
exclusions of indirect and consequential loss and its cap on aggregate liability.
- What HeyFitt is not responsible for. HeyFitt is a place to find someone to train with.
It does not screen, vet, verify, or background-check members; it does not supervise
training; it is not a party to any arrangement you make with another member; and it does not
own, operate, or control any gym. Sections 4 to 8 of the Terms set this out and are not
modified by this Addendum. Your assumption of risk under Sections 5 and 7 stands, save that
it does not extend to any liability described in Section A5.1.
A6. Ending the agreement
- You may close your account at any time, as Section 16 of the Terms provides.
- Where you have paid for a service that has not yet been supplied, your cancellation rights
under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations
2013 apply. Where you ask us to begin supplying a digital service during the cancellation
period, you may be required to pay for what has been supplied up to the point of
cancellation.
- HeyFitt may suspend or end your access as Section 16 of the Terms provides. Where we do so
other than for your breach, and you have paid for a period that has not been supplied, we
will refund the unsupplied part.
A7. Complaints
- Write to us first. Our legal inbox is the fastest route and is named in Section 20.1 of the
Terms. We aim to respond within thirty (30) days.
- If we cannot resolve your complaint, you may be able to use an alternative dispute
resolution scheme, and you may bring proceedings under Section A3.2. Using a complaints
process is not a condition of your right to go to court.
A8. Price changes, and charging for what is free today
- Section 15 of the Terms applies to you, with the additions below. We may introduce
fees for features that are free today and change the price of paid features.
- Notice and your right to leave. Where a change increases a recurring amount you pay, we
will give you at least thirty (30) days' notice, and **you may cancel before the change
takes effect without penalty and without paying the increase**. Where a feature you are
using becomes payable, you will not be charged for it unless you choose a paid plan.
- A price we have already taken payment for does not change mid-period. A change applies
from your next renewal, not to a period you have already paid for.
A9. If we withdraw the Service
- Notice. Where we discontinue the Service or a paid feature generally, we will give you
notice we consider reasonable in the circumstances, and we may act immediately where we
consider it necessary — including for security, safety, legal, regulatory, fraud, or abuse
reasons, or where notice is not practicable.
- Your data. Before access ends we will make a reasonable effort to offer you an export of
the information associated with your account in a commonly used, machine-readable format.
This is in addition to, and does not replace, your right of access and your right to data
portability under UK data protection law, which you may exercise at any time.
- Refunds. Where you have paid for a period or an allowance we do not supply, **we will
refund the amount you paid for the part not supplied.** This obligation is not conditional
on anything, and Section A5.1 is unaffected. Where we end your access because you breached
the Terms, no refund is due for the unsupplied part.
A10. How long we keep your information
- Section 25 of the Terms describes why we retain information and for how long. **That
retention is subject to UK data protection law, which this Addendum does not and cannot
displace.**
- You have the right to ask us to erase your personal data, and the right to object to
processing, to restrict it, to access it, and to receive a copy of it. Where an exception
applies — for example where we must keep records to comply with a legal obligation, to
establish or defend legal claims, or to keep a banned account from returning — we will tell
you which one and keep only what that purpose needs.
- Information that has been aggregated or anonymised so that it no longer identifies you is
not personal data, and we may keep and use it indefinitely.
A11. Promotions, offers, and advertising
- Consent, where the law requires it. Where we use your personal data to select
advertising, offers or recommendations for you, and UK law requires your consent for that
use, we will ask for your consent first and you may refuse or withdraw it at any time.
Withdrawing consent is free, takes effect for the future, and does not affect your use of
the Service.
- We do not hold information about your health. HeyFitt asks for none and has no field
for one — no injuries, conditions, medications or body measurements. What you log is the
exercise and the weight on the bar, which records what you lifted rather than anything
about your body, and we do not treat it as special category data. If we ever introduce a
feature that collects health information, we will obtain your explicit consent first,
and a separate explicit consent before any of it is used to select advertising. Health
information a trainer records about you belongs to that trainer as controller, not to us.
- Direct marketing. You may object to direct marketing at any time and we will stop.
There is no exception to this right and you do not have to give a reason.
- Our Privacy Policy is the description of record of what we actually do with your
information. Where this Section and the Privacy Policy differ, the Privacy Policy governs,
and we will update it before we begin any use it does not describe.
A12. Everything else
- Every other provision of the Terms applies to you unchanged, including Section 9 (your
content and the licence you grant), Section 10 (prohibited conduct), Section 12 (our
intellectual property), Section 19 (indemnification), and Section 22 (changes to the Terms).
- Severability. If any provision of this Addendum is held to be unenforceable, that
provision is severed and the remainder of this Addendum and of the Terms continues in force.
Section 20.9 of the Terms does not apply to this Addendum.
- This Addendum is written in English, and English is the language of any dispute under it.
